Oftentimes, confidentiality provisions in settlement agreements are insisted upon by the insurance companies, medical and allied professionals, and other entities we have sued for wrongful conduct. Dangerous Drugs & Medical Devices

Description: Dangerous Drug - $700 million settlement global settlement of approximately 8,000 cases with drug company Eli Lilly $700 million settlement for allegations that the atypical anti-psychotic drug Zyprexa caused diabetes and diabetes-related injuries. Diabetes is a very serious condition with several serious complications. The lawsuits alleged that Eli Lilly failed to adequately warn patients and their doctors about the drug’s known association with diabetes and other injuries. Steven M. Goldberg Co., LPA participated in this suit as Ohio counsel representing hundreds of injured Ohio consumers, working on their behalf to help reach this settlement.

Description: Product Liability - MRI Contrast - Confidential compensation awarded for debilitating injuries. The manufacturers should have known, that their products, were not reasonably fit, suitable or safe for their intended purpose and, specifically, that they were defective and unsafe for use in patients with renal insufficiency, such as our client who suffered severe physical injury.

Description: Product Liability - Bard Inc. agreed to pay $184 million in settlment of 2,600 Kugel Mesh lawsuits. The cases involve the Kugel surgical mesh patches made by Davol between 2001 and 2006. The patches design includes a “memory recoil ring” that redeploys once inside the abdomen. According to the lawsuits, some of the rings broke under stress, and consequenlty became loose and migrated throughout the body, resulting in stomach pain, perforated bowels and, in some instances, death. Following reports of injuries, Davol began a recall of the patches, which was followed by an FDA-issued mandatory recall for a range of Kugel Mesh patches. Steven M. Goldberg participated on behalf of his Ohio clients as co-counsel to the Motley Rice firm in Providence, R.I., co-lead counsel and liaison counsel for the Plaintiffs in the MDL.

Description: Vaccine Injury - Parents and child awarded compensation for injuries suffered after their son, who was given a DPT vaccine, suffered a vaccine-related encephalopathy. The special master found that the young man's mental retardation and seizure disorder were a result of this vaccine-related injury and an award was annuitized providing for lifetime payment of approximately $9 million dollars. Instead of suing the doctor, nurse, clinic or the maker of the vaccine, vaccine injury claims had to be submitted to the National Vaccine Injury Compensation Program. But not every lawyer is experienced with recovering compensation from this program which requires special admittance to the Unites States Federal Claims Court.

Description: Vaccine Injury compensation awarded as a result of a vaccine injury. Claimant suffered from a residual seizure disorder. An award was annuitized providing for lifetime payments of nearly $2.5 million dollars.

Description: Pacemaker - Global settlement - Case involved a nationwide products liability action against a pacemaker manufacturer for placing into the stream of commerce a defective pacemaker lead. The terms of settlement are confidential.

Description: Dangerous Drugs - Celebrex / Bextra The world’s largest drug company agreed to a $894 million dollar global settlement to resolve personal injury claims for the painkillers Celebrex and Bextra. While Celebrex is still on the market, Bextra was removed in 2005 due to safety concerns over cardiovascular risks and some life-threatening skin reactions. Celebrex then received a black box warning, the strongest issued by the FDA. Steven M. Goldberg Co., LPA participated as local counsel in these suits on behalf of many injured Ohio consumers and worked on their behalf to help reach this settlement.

Description: Dangerous Drug - L-Tryptophan - compensation for injuries suffered after middle aged woman used L-tryptophan and/or products containing L-tryptophan. The terms of the Settlement are confidential.

Asbestos Cancer / Mesothelioma

Description: Mesothelioma - $2.8 million awarded to a New York plumber’s wife and family for injuries suffered as a result of his mesothelioma caused by exposure to asbestos.

Description: Mesothelioma - $1.6 million settlement awarded to an Ohio worker and his children as a result of his mesothelioma caused by exposure to asbestos.

Description: Mesothelioma - $1.2 million settlement awarded to an Ohio worker, his wife and children as a result of his mesothelioma caused by exposure to asbestos.

Description: Mesothelioma - $700,000.00 settlement awarded to an Ohio worker, his wife and children as a result of his mesothelioma caused by exposure to asbestos. 

Description: Mesothelioma - $500,000.00 settlement awarded to a Virginia worker and his children as a result of his mesothelioma caused by exposure to asbestos.

Description: Mesothelioma - $365,000.00 settlement awarded to an Ohio worker, his wife and children as a result of his mesothelioma caused by exposure to asbestos.

Aviation and Auto Accident

Description: Aviation - Wrongful Death Confidential settlement awarded to the children of a doctor and his wife who were passengers on international flight which crashed off Nova Scotia killing 227 others.

Description: Aviation - Wrongful Death $1,140,000.00 settlement awarded to the family of a young woman passenger aboard US AIR Flight 427, a Boeing Aircraft 737 which crashed on its approach to Pittsburgh InternationalAirport. The aircraft suffered an uncommanded rudder deflection resulting in an uncontrolled roll of the aircraft.

Description: Truck - Wrongful Death $1,518,104.50 Pre suit settlement on behalf of surviving children whose father was fatally injured when garbage truck negligently backed up and ran over him.

Description: Auto - Wrongful Death $ 165,000.00 89 year old woman pulled out of a private driveway on to roadway with no lights on when a teenage driver traveling at a high rate of speed struck her automobile broadside.

Description: Auto - Wrongful Death $130,000.00 94 year old man was fatally injured while being transported via ambulette to a dialysis appointment. The driver of the ambulette struck the rear of a vehicle stopped in traffic.

Description: Auto - Personal Injury $300,000.00 Client was a passenger in her vehicle when a tractor -trailer crossed lanes of travel causing the trailer to strike the vehicle with such force that the entire front end became wedged underneath the trailer and was dragged sideways approximately 800 feet by the trailer. Client was pinned to her seat by the door and the dash. She sustained serious painful physical injuries.

Description: Motorcycle - Personal Injury $950,000.00 Client was operating a motorcycle when a motorist carelessly and without warning failed to negotiate a curve and struck Client’s motorcycle causing him severe and disabling injuries.

Description: Motorcycle - Personal Injury $690,000.00 Client was operating a motorcycle when a motorist carelessly and without warning pulled out from a private drive on to a public road causing client to drop his bike and roll in to the car.He suffered an aggavation of prior injuries.

Description: Motorcycle - Wrongful Death $310,032.00 Client was riding on the back of a motorcycle when the driver lost control throwing her. Client sustained immediate head injuries and died at the scence of the accident. 

Description: Auto - Personal Injury $242,250.00 Clients were two of six teenage passengers in a motor vehicle driven by a young man at a high rate of speed when he ran off the road striking a curb and a stone bridge. Three of the six passengers were fatally injured. Both clients were injured but there was limited insurance proceeds to recover.

Description: Auto - Personal Injury $185,000.00 Client was traveling northbound on roadway when a south-bound motorist lost control of her vehicle and slid across to the northbound lane and hit Client head on. Client suffered a wrist fracture.

Description: Auto - Personal Injury $165,000.00. Client was traveling southbound and was proceeding through an intersection pursuant to a green traffic signal for north and southbound traffic when a motorist while operating his automobile northbound suddenly and without notice or warning, turned into Client's path causing a collision.  The Client sustained severe and permanent injuries from the accident. 

Description: Motorcycle - Personal Injury $150,000.00 Client was operating his motorcyle when a motorist, without any notice or warning, pulled out of a private parking lot and struck Client’s motorcycle causing Client to suffer a wrist dislocation and fracture.

Description: Auto - Personal Injury $100,000.00 Client was traveling westbound and a motorist was driving eastbound on State Route 625 when he pulled into Client’s path while attempting to make a left hand turn. The accident caused Client to suffer moderate personal injuries.

Description: Auto - Personal Injury $100,000.00 Client was traveling eastbound and was proceeding through an intersection pursuant to a green traffic signal when a motorist while operating his automobile westbound suddenly and without notice or warning, turned into Client's path causing a collision.  The Client sustained severe and permanent injuries from the accident. 

Description: Falling Tree Limb - Personal Injury While driving on State Route 304 in Trumbull County, Ohio, Client’s pickup truck was struck by a falling tree limb crushing his truck causing injuries to himself and his two children who were in the truck with him. The terms of the Settlement with the Ohio Department of Transportation are confidential.

Description: Auto - Personal Injury $100,000.00 Client was stopped on roadway attempting to turn when a motorist traveling southbound failed to stop in an assured clear distance striking Client’s vehicle causing her to sustain moderate personal injuries.

Description: Auto - Pedestrian Personal Injury $500,000.00 94 year old woman was standing behind a truck parked on a one way street to keep warm when the driver backed up and ran her over. Client sustained a pelvis fracture.

Railroad Injuries and Death

Description: Railroad Crossing - Wrongful Death Decedent, age 26, was a passenger in a vehicle that was struck by a train at a crossing with no flashing lights and no roadway gates. The terms of the settlement with Consolidated Rail Corp. are confidential.

Description: Railroad Crossing - Personal Injury Gerald Carpenter sued Conrail after he was hit by a train on Ohio 172 near Moultrie in northeastern Ohio. Conrail had marked the crossing with an advance warning sign that had yellow flashing lights, pavement markings and railroad cross-bucks. The suit alleged Conrail failed to adequately warn motorists of the crossing. Conrail asked for an immediate ruling by the lower court on the grounds that federal law made the state responsible for making sure crossings were safe and adequately marked. Without a hearing, the trial court agreed with Conrail and ruled that federal laws regarding railroad warning devices blocked Carpenters lawsuit. Carpenter repealed the court’s ruling and the 7th District Ohio Court of Appeals reversed the decision. The case was forwarded to the Ohio Supreme Court for review. The Supreme Court unanimously upheld the Appeals Court ruling thereby allowing Carpenter to sue Conrail for damages relating to the crash. The court reaffirmed motorists’ rights to sue railroad companies if railroad crossing warning signals cause them to have an accident. The case was referred back to the Mahoning County jury and was resolved the day of trial for a confidential amount. The case is reported as Carpenter v. Consolidated Rail Corp., (1994), 69 Ohio St.3d 259.

Personal Injury

Description: Dialysis - Personal Injury $650,000.00 Shortly after receiving a dialysis treatment, Client became ill and was taken to the hospital and treated for bacterial sepsis. Subsequent testing revealed that there were elevated bacterial levels in the water supply being used in the dialysis treatment of patients.

Description: Dialysis - Personal Injury Shortly after receiving a dialysis treatment, Client became very ill and had to be transported to the local hospital, where he was admitted and treated for infected vascular access and systemic inflammatory response syndrome (SIRS). The dialysis center broke anti-contamination rules thereby infecting Client causing him serious, severe, painful physical injuries. The terms of the settlement are confidential.

Description: Work Accident - Personal Injury $800,000.00 Client while operating a Caterpillar D400 hauling truck, was backing down a slope to dump a load and stone and gravel. A brake and/or mechanical failure not within Client’s control caused the truck to accelerate, roll and bounce backwards down 500 feet until it impacted abruptly with a service road drainage ditch at the bottom of the slope. Client suffered a broken back, no surgery. He was off work for nearly one year.

Description: Work Accident - Personal Injury $100,000.00 Client was walking through work plant when, without notice or warning, he was struck on his right forearm by a C-Clamp that had fallen from the 4th floor.  The cause of the accident and resulting injuries was an independent contractor’s failure to properly secure tools while working overhead; failure to adequately bulk the head-off area; and, failure to barricade below to inform other workers that men were working above. Client was treated for a laceration to his forearm and a Grade 2 open comminuted distal radial shaft fracture.  Client underwent open reduction and internal fixation of distal radius fracture.

Hospital, Medical and Dental Malpractice/Wrongful Death

Description: Emergency Room Error - Wrongful Death $1,300,000.00 Woman presented to a regional hospital in Class III shock. She was never adequately evaluated and/or resuscitated despite obvious signs of shock and volume depletion. She was transported to Level I trauma center where she sat in the E.R. for 4 ½ hours in obvious hemorrhagic shock without a single lab test despite initial abnormalities and progressive deterioration after a “therapeutic tube” had been placed. She received less than a liter of fluid, with no urine output and no attempt to measure it despite having put out more than 1 liter of blood initially and a total of 2 liters in the first 4 hours from a chest tube that was miniscule, inappropriately placed  and obviously inadequate based upon the single portable image that was taken afterward; despite a subsequent measured hemoglobin of 6.5 while still in the ED still not a single tube of blood sent for type and cross match. This poor woman didn’t get a drop of blood transfused into her body until she was in full arrest and clinically dead.

Description: Medical Malpractice – Wrongful Death – Premature transfer of patient from CICU to a minimally-monitored floor.  59 year-old patient exhibited multiple signs and symptoms of progressive congestive heart failure while in CICU. He was prematurely discharged from the CICU to a regular nursing floor in active and progressive congestive heart failure and became hypoxemic. This led him into progressive heart failure. Had he remained in the ICU, his hypoxemia would have been detected earlier, leading to definitive treatment of his heart failure before his arrest with resultant anoxic encephalopathy and death. Description: Medical Malpractice - Misdiagnosis -Wrongful Death $650,000.00 Client died after suffering for a substantial amount of time from a cancerous growth behind his right knee that defendants’ failed to diagnose before the cancer metastasized. Client had to undergo extensive surgeries, radiation therapies and chemotherapy all in a failed effort to slow the growth of the cancer.

Description: Medical Malpractice - Wrongful Death $650,000.00 Doctor #1 allowed a pacemaker infection to become septic and spread throughout Drew’s body. Drew had Down’s Syndrome and had a heart condition which was being cared for by a pacemaker which had been inserted at the time he was a baby. The pacemaker infection was not taken care of by antibiotics for about 72 hours thus delaying his surgery to drain the pocket infection for several days. After his surgery Drew required supplemental oxygen to breathe and Doctor #2 tried to wean Drew off oxygen and eventually sent him home with no pulse oximeter to see if he desaturated and oxygen only to be used when he slept. Drew died of respiratory failure.

Description: Medical Malpractice - Wrongful Death $600,000.00 Doctor, in attempting to perform laparoscopic gallbladder surgery and utilizing insufflation equipment, failed to properly operate and manage such equipment causing complications to occur causing a cardiac arrest leading to Client’s death.

Description: Medical Malpractice - Wrongful Death $450,000.00 Client’s death occurred as a result of multiple pulmonary emboli originating in the deep veins of her left leg, which condition was treatable and which condition could have been reversed with the proper diagnosis and treatment that was available.

Description: Medical Malpractice - Wrongful Death $450,000.00 Terminally ill patient was carelessly administered a lymphocytic transfusion which contained contaminated autologous lymphocytes, resulting in septicemia and multi system organ failure. Patient died five days after this administration of contaminated autologous lymphocytes, after developing multi system organ failure, sepsis, and shock.

Description: Medical Malpractice - Misdiagnosis - Wrongful Death $417,500.00 Client died as a result from complications of a ruptured appendix. Doctor failed to diagnose decedent’s abdominal condition and failed to admit him to hospital for care and treatment.

Description: Medical Malpractice - Personal Injury $370,900.00 Client was admitted to hospital for a scheduled laparoscopic Nissen fundoplication. Doctor failed to properly monitor, diagnose, care for treat and test Client, and failed to timely recognize postoperative bleeding. Doctor failed to recognize and treat Mr. Reese Client’s splenic injury resulting in unnecessary blood product replacement, respiratory failure and permanent injury and damage.

Description: Medical Malpractice - Wrongful Death - $400,000.00 Failure to diagnose cancer: Primary care doctor failed to identify, diagnose or treat elderly gentleman's squamous cell cancer of his right ear and failed to refer him to another physician or arrange for further therapy. As a result of the Doctor’s substandard care and negligence, our Client died prematurely.

Description: Medical Malpractice - Misdiagnosis - Wrongful Death $390,000.00 Client was severly injured in a construction accident when he was drawn into an auger causing a laceration of his right side near his armpit. Client complained of neck and back pain and cervical x-rays were taken but were incomplete in that they did not visualize the 7th cervical vertebrae. Repeat cervical x-rays were again incomplete. Client had been placed in a chair and was walking and by the fourth day was a quadriplegic. Within one week Client died.

Description: Medical Malpractice - Medication Error - Wrongful Death $262,500.00 Hospital permitted the administration of inappropriate/non-prescribed medications to Client and then failed to properly monitor, identify, diagnose or treat her rapidly deteriorating condition at a point in time when it was still possible to prevent her death.

Description: Medical Malpractice - Misdiagnosis - Wrongful Death $245,000.00 Client, unmarried and no children, died as a result of lung cancer which went unaddressed at the time when therapy would, more likely than not, have been curative. Because of the doctor’s negligence, her cancer was permitted to grow from an early treatable stage to an advanced incurable stage.

Description: Medical Malpractice - Misdiagnosis - Wrongful Death $225,000.00 Doctor was negligent in failing to identify, diagnose or treat late stage colon cancer. Client’s life expectancy was diminished as a result of the missed diagnosis.

Description: Medical Malpractice - Wrongful Death $221,500.00 Client had a significant history of upper and lower back pain, attributed to a motor vehicle accident in 2001. He went to see Doctor for his persistent back pain and drug dependency. Doctor ultimately prescribed Client a lethal dose of the narcotic Methadone, in conjunction with Diazepam. After taking the prescribed medications Client died.

Description: Medical Practice - Emergency Room Error - Wrongful Death $100,000.00 Client, 78 years of age, presented to the emergency room and the triage assessment failed to identify his significant history of vascular disease or coronary artery disease. An ECG was obtained which identified numerous abnormalities. Client was given Mylanta and discharged home where he died some four and one-half hours later.

Description: Medical Malpractice - Emergency Room Error - Confidential settlement of birth defect lawsuit in the wake of a $2.5 million payment suggested by panel of arbitrators. Doctor wrongfully prescribed medication that would eventually harm fetus causing severe retardation of skeletal development. Mother informed the ER physician that she might be pregnant and he gave her the antibiotic Vibramycin and should have known the drug can cause problems for pregnant women.

Description: Medical Malpractice - Misdiagnosis $2,000,000.00 As a direct result of the Doctors’ negligence and substandard care in misinterpreting the pathology slides as benign whereas in fact they were malignant superficial spreading melanomas, Client’s diagnosis of malignant melanoma was delayed over a two-year period. Had Doctors timely and properly diagnosed her biopsy tissue, Client’s cancer would have been timely and properly diagnosed so that she would have been successfully treated and cured of her cancer.

Description: Medical Malpractice - Misdiagnosis $170,000.00 Doctor failed to properly diagnose, treat, and if necessary, remove a tumor and/or growth and/or repair a vision issue on Client.

Description: Medical Malpractice - Misdiagnosis $150,000.00
Doctor misdiagnosed 13 year old boy’s slipped capital femoral epiphysis, despite the obvious displacement as indicated on the x-rays.

Description: Medical Malpractice $130,000.00 Doctor negligently prescribed antidepressants while failing to have sufficient knowledge, skill and training in the treatment of mental disorders in adult patients. Patient should have been referred to a specialist with more training in psychological conditions but was not and he eventually tried to take his own life.

Description: Medical Malpractice - Emergency Room Error $700,000.00 Client with diabetes and peripheral vascular disease presented to the ER as instructed by her primary care doctor and was there several hours where the ER personnel failed to evaluate or monitor Client or to notify a vascular surgeon of the significant changes in her condition. By the time Client had a surgical consult, her leg was unsalvageable and required and resulted in a below the knee amputation.

Description: Medical Malpractice - Birth Injury $115,000.00 Despite the request of birth mother for a C-section, Doctor performed a forceps delivery causing infant to suffer minor brachial plexis injury.

Description: Medical Malpractice $285,000 Doctor's insurance company was bankrupt and settlement was subject to a $300,000 OIGA cap. Patient, during surgery to remove her non-functioning left kidney, had a portion of her descending colon perforated. This went unnoticed allowing fecal material to leak through her incision site. The perforation was small but the surgeon removed a six inch segment of the bowel and installed a colostomy. After discharge from the hospital, Patient was able to eat normally and gained weight. During the surgical removal of the colostomy, Patient suffered multiple tears to her small intestine. During surgery to correct these tears, the surgeon removed 40% of Patient’s stomach without her consent. After undergoing years of numerous surgeries to correct the surgeons’ errors and suffering much pain and mental anguish, Patient died.

Description: Dental Malpractice Dentist performing implant dentistry procedure in Client’s jaw failed to determine whether her jaw was capable of sustaining implant work and failed to identify a pre-existing infection in her lower jaw before the implant procedure. Client suffered an osteomyelitis (bone infection) of her lower jaw. She had to have oral surgery and suffered a lengthy period of excruciating pain and discomfort. The terms of this settlement are confidential.

Description: Medical Malpractice Client, a fashion model, had a procedure utilizing a fiber optic device which caused Client to suffer full-thickness third-degree burns on her chest. Doctor also failed to properly treat the burn and Client suffered permanent scarring of her chest as a result. The terms of this settlement are confidential.

Description: Medical Malpractice – Wrongful Death - Failure to Diagnose Cancer Doctor failed to order a biopsy of tissue removed from Client’s vagina and failed to identify or treat her vaginal cancer until it progressed to an advanced state, thereby shortening her life. The terms of this settlement are confidential.

Description: Medical Malpractice While undergoing a laparoscopic vaginal hysterectomy, Doctor stapled a portion of Client’s small bowel to the right pelvic side wall and failed to recognize or treat it appropriately. Client suffered permanent damage to her small bowel and ultimately required a segment of bowel to be removed. The terms of this settlement are confidential.

Description: Medical Malpractice - Birth Injury Doctors failed to determine that mother’s fetus was in a state of fetal distress while she was in the delivery room and delayed performing a Cesarean section causing her son to sustain severe irreversible brain damage. The terms of this 7 figure settlement are confidential.

Description: Medical Malpractice - Medical Instrument Left After Surgery Doctor and surgical nurse failed to discover and remove a hook measuring 5.5 x 2.1 x 1.3 cm from Client’s lower back causing additional pain and discomfort necessitating further surgery and hospitalization for the removal of the hook. The terms of this settlement are confidential.

Description: Medical Malpractice $450,000.00 Doctor failed to identify a major nerve and dissected it thereby paralyzing Client’s vocal cords. Client speaks just above a whisper.

Description: Dental Malpractice - Product Liability Dentist was careless in extracting several teeth, using such force causing the extraction forceps to break and enter Client’s throat, and then lodging in her right lung. Forceps were defective and failed to perform in the manner for which it was intended, causing Plaintiff to undergo further surgery in order to remove the foreign body from her right lung. The terms of this settlement are confidential.

Description: Wrongful Death - Doctor performed an angioplasty procedure and installed a temporary pacemaker upon decedent. While attempting to place said pacemaker, Doctor perforated the inferior vena cava and failed to recognize that he has caused said perforation thereby causing Decedent to hemorrhage internally. Health Center failed to monitor Decedent’s condition and failed to call for a physician during the critical period of Decedent’s deterioration, and were negligent in failing to carry out the attending physicians’ orders in a timely fashion. Additionally, Doctor failed to respond to a nurse’s call for a period of 40 minutes or longer during which period of time Decedent’s condition became critical and she had to undergo emergency surgery. Due to the combined carelessness and negligence of the healthcare providers, Decedent suffered severe and excruciating pain for approximately 6 hours following the surgery and she ultimately died. The terms of this settlement are confidential.

Description:  Nurse Error - $100,000.00 Client had  malignant mesothelioma.  He was in an ICU setting  surviving on only one lung.  His providers knew, or should have known, that any threat to his working lung function was potentially lethal to him. A nurse attempted to place a feeding tube and penetrated his good lung causing a pneumothorax.  A product liability lawsuit is pending.

Nursing Homes and Geriatric Care

Description: Civil Rights Section 1983 William R. Vaughn vs. Detective Sgt. Robert Davis, City of Youngstown, Youngstown City Police Department: A Cleveland federal court jury declined to award money to a convicted burglar who said his civil rights had been violated by the Youngstown police officer who shot him five times. An eight member jury found that Detective Sgt. Robert Davis did not violate the civil rights of William R. Vaughn. Vaughn sued Davis, the city of Youngstown, and the police department for $10 million. US District Judge John Manus presided over the week long proceeding. Vaughn was a burglary suspect whose car was spotted byDavis on the south side of Youngstown in October 1992. Davis reported that Vaughn stopped his car, fled on foot and was shot when he doubled back and tried to get into Davis' cruiser and grab the 12 gauge shotgun on the rack. Vaughn alleged he was shot five times as he fled from his car.

Description: Aggravated Robbery Youngstown City Police Patrolman Christopher Lombard was accused of assaulting and robbing a drug dealer in the restroom of a bar in March 2001. Officer Lombard was terminated from his job as a police officer after charges were filed against him. Attorneys Steven and Michael Goldberg represented Office Lombard at trial.
